Guitar not delivered - what can I do ?

Until now,I'm still waiting...can anybody tell me what I can do against those guys ? I ordered the guitar in a uk musicstore,not somewhere in the chinese jungle.There must be a way to get what I have paid for or my money back.I guess the german police cannot really help.Should I search for a lawyer,specialised in international business ? I will call once more this morning but all I will hear are some more fairy tales.Has anybody had similar problems in the past ?
 
did you pay by credit card? I don't know about german law, but in the UK you have a lot more protection in the UK if you pay by credit card, the credit card company is equally liable (something like that).

Paypal was the only payment method they accept and paypal covers only 500 euros.I already asked them what to do but it's rediculous...they take your fees only and leave you naked in the rain in case of trouble
 
I dont know how it would work in Germany but I had a similar problem with an electrical company when I bought a DVD recorder a couple of years ago, they could not deliver by Christmas and would not give me my money back. I took them to the county court, (all done on line and only cost ?50) They were made to return my money and pay my costs. Worth looking into it certainly shook them up when they received a summons.

That's what I would prefer but it could be difficult for me as a german citizen.But if nothing happens til friday I try to ask the british police per email what to do and if they cannot help go to a lawyer.I fortunately have an insurance to cover the costs for lawyer and court costs.Hard to believe such things happen in 2010 when ordering from an official musicstore
 
If they don?t make any movement just fill a claim in Europol,there must be a way to fill it in internet or in your local police station.It?s a fraud clearly.
It could happen they just adveritsed a guitar they don?t have and just asked someone to make and are waiting....Check for it also...And make a lot of noise....If it?s a Tokai try to ask Tokai Gakki factory if other just contact factory,I would suggest directly with someon speaking english at your side...Just let me know how this affair ends.
 
It's a prs in this case and I already had the idea to inform prs uk.
As far as I know about prs quality standards,they will not accept such a bad reputation.On the other site,I should have googled earlier,this behavior seems to be absolutely normal for this musicstore,I am not the only one... :oops:

Fortunately the expandora pedal makes no problems.It's in the customs and can be picked up tomorrow :lol:
 
Sorry to hear about this. Maybe a County Court summons is the only way to persuade them to refund you. :( Possibly you could find an English speaking German solicitor who could send a warning letter & then issue a summons if the letter doesn't work?

This will be the next step.I called the shop this afternoon and was really upset but you know,the problem is to find the right words.If you are to nasty,it mostly won't help.The guy I spoke with told me he will take care for a tracking number and give me information about it later but I told him I cannot believe it anymore,since I had all this promisses and ********.Ok,I received a message 10 minutes later with a number and the information that they will directly call the courier to find out where the guitar is.When I check the number,there are no informations yet,so I suppose,the guitar is still in the store.I made clear that I will inform the UK PRS supplier and a lawyer will be active as well.

I opened a disput already because after one week without tracking number and information,I've lost my patience and informed paypal.When I tried to reach somebody in the musicstore,they told me the guitar is ready for shipping but I had to stop the disput first to make sure they will get the money.And the sales manager promissed to ship it the same day.So I finished the disput but if you do so,it is not possible anymore to reopen it again...One day later I received the information that the guitar will be picked up in the next hours.Since then nothing until yesterday...they gave me a tracking number but when I called uk mail,the guy told me the number doesn`t exist,the item has never been shipped.I called the musicking 3 times,first the guy hung up,second try,I hung up after waiting 5 minutes,third try the same as the second...what now ???
 
You have waited long enough, this is not going to end the way you like it. So it's better to get hold of the situation again > legal action!

I had one problem with italian spedition company Bartolini (now I understand "no longer shipping to Italy" on lots of ebay pages), they broke my amplifier. I contacted them couple of times without any success (the package was insured).
Then I contacted local counsumer center, they're very very helpfully. They sent me online compain form, I wrote it in local language, they translated into italian language and forward compain to Italian consumer center. Now I'm waiting for results. You can try this, just find your local center.
 
You could also try the Birmingham Citizens' Advice Bureau. Technically, I don't think they're obliged to help you, since you're not a local resident, but from my experience of local CABs when I lived over there I think they probably would. To find out, all you'd need to do is make a phone call.

It looks like it will come to a good end...I left a message on the headlinemusic website 2 days ago,it's the uk PRS distributor and within one day I had a reply.They contacted thebloodymusicking immediately and without going into details,I can read between the lines that this was no fun for the poor so called sales manager :lol: The director from headline told me that I will receive the guitar for sure in 7 days or less and also announced consequences for this musicstore.
One thing to remind : themusicking sells tokais and pleas think twice before ordering there ! I am totally happy not to loose my money to those gentlemen and I guess with this kind of service the store will disapear as fast as it came up.
